NOTABLE ONE LINERS Banks Act Exclusion from the provisions of that Act and its requirements has been gazetted for the New Development Bank, in the lawful carrying on of activities related to the business of a bank. Copyright Act Reminder that current SAMRO accreditation ends September 2019. Electronic Communications Act Comment deadline on the draft findings document on the inquiry into subscription television broadcasting services (available from ICASA) has been extended to 4 October 2019. Financial Sector Regulation Act The commencement date for chapter 14 (Ombuds) is now 1 October 2020. Financial Services Ombud Schemes Act The Financial Sector Regulation Act will now repeal this Act on 1 October 2020. Housing Consumers Protection Measures Act The Draft Housing Consumer Protection Bill proposes repealing this Act. Immigration Act The Constitutional Court (CCT11/18) held that regulation 9(9)(a) is inconsistent with the Constitution and invalid, to the extent that the rights accorded by means of the exceptional circumstances contemplated in section 10(6)(b) are not extended to the foreign spouse or child of a South African citizen or permanent resident. The declaration Page 3 of invalidity is suspended for 24 months from the date of this order. During the period of suspension, the following is to be read into regulation 9(9)(a) of the Immigration Regulations: “(iii) is the spouse or child of a South African citizen or permanent resident.’ Labour Relations Act Accreditation for the Motor Industry Bargaining Council, and Bargaining Council for the Grain Industry, gazetted. Long-term Insurance Act Reminder that amendments relating to regulation 3.21 (remuneration that may be offered or provided to a binder holder) commence for certain types of binder agreements, and amendments relating to Part 8 (authorisation of and requirements for collection of premiums by intermediaries), will commence 28 September 2019. National Environmental Management Air Quality Act (i) Amendments have been proposed for the national greenhouse gas emission reporting regulations. Comment deadline 30 days from 6 September 2019. (ii) Notices have been gazetted for the proposed repeal of the regulations regarding fuel burning appliances in dwelling houses, proposed repeal of smoke control regulations (and smoke control zone orders), and proposed repeal of inspection of premises in dust control areas (and dust control areas). Comment deadline: 30 days from 30 August 2019. National Environmental Management Waste Act Draft norms and standards for organic waste composting have been proposed, for organic waste composting facilities that have the capacity to process compostable organic waste in excess of 10 tonnes per day. Note: Such an organic waste composting facility will be required to comply with these national norms and standards, without the requirement of obtaining a waste management licence in terms of the National Environmental Management: Waste Act.
