 Federal Acquisition Regulations 
 The following information will provide details of Federal Acquisition Regulations (FAR) as they relate to human 
 trafficking, and the role of the FAR.

  Federal Acquisition Regulations and Human Trafficking 
   
    •     In support of the zero tolerance policy, FAR 22.17 requires all Government contracts to prohibit 
          Contractors, Subcontractors, and their employees from engaging in severe forms of trafficking in 
          persons, procuring commercial sex acts, and using forced labor during the period of performance of the 
          contract. 
           
    •     FAR 22.1704 [https://www.acquisition.gov/far/current/html/Subpart%2022_17.html #wp1088114] 
          provides the Government’s recourse in the event of a violation. 
           
    •     FAR clause 52.222-50 [https://www.acquisition.gov/far/current/html/52_222.html#wp1151848] outlines 
          the United States Government’s zero tolerance policy with regard to trafficking in persons. The clause 
          also provides tools for the federal acquisition workforce to use in combating human trafficking through 
          the contracting process. 
  Role of the FAR 
   •     Combating trafficking is an important administration initiative with bipartisan support from 
         Congress.  
          
   •     More than a dozen US Government agencies actively engage in anti-trafficking activities, but there 
         is a critically important role for acquisitions professionals to  ensure that no Contractors use forced 
         labor or engage in commercial sex.  
          
   •     Rooting out forced labor in Government contracts can help protect exploited workers, ensure that 
         those Contractors do not perform work for the US Government, and can help bring those 
         Contractors to justice.  
          
  Federal Acquisition Regulations and Human Trafficking 
    •     FAR 52.222-50 must be inserted into all Federal solicitations, contracts, and subcontracts.  
           
    •     Contractors are required to notify employees about the zero tolerance policy and the consequences of 
          violating that policy. For example, employees may be removed from the contract, have their benefits 
          reduced, or be terminated.  
           
    •     Contractors must also take action against employees or Subcontractors who are found in violation. 
           
    •     As a member of the Federal acquisition workforce, you play a crucial role in combating human 
          trafficking before contract award, during contract administration, and in pre- and post-award.
