Subject: Notice u/s 5 of Environment Protection Act, 1986 read along with Plastic Waste Management Rules,
2016 for Registration/ Renewal under PWM Rules - reg.
Whereas, Ministry of Environment, Forest and Climate Change, Govt. of India has notified the Plastic Waste
Management (Amendment) Rules, 2018. These rules shall apply to every waste generators, waste processors and
manufacturers of plastic carry bags, multi-layered packaging material.
And whereas, as per Plastic Waste Management (Amendment) Rules, 2018, all persons who generate, collect, st~re,
transport, re-use, recycle and dispose plastic waste in any form including importer, producer, individuals or agencies,
groups of individuals voluntarily engaged or authorized, are required to obtain registration under the Plastic Waste
Management (Amendment) Rules, 2018 and Consent to Operate under Water (Prevention and Control of Pollution)
Act, 1974 and Air (Prevention and Control of Pollution) Act, 1981 from Delhi Pollution Control Committee.
And whereas, the Rule 13 of the Plastic Waste Management (Amendment) Rules, 2018 provides:-
• No person shall manufacture carry bags or recycle plastic bags or multilayered packaging unless the person
has obtained a registration from Delhi Pollution Control Committee, prior to the commencement of
production;
• Every producer (Plastic Carry Bags/ Sheets/ Packaging materials/ Tripals/ Pet Bottles etc. & like) shall, for
the purpose of registration or for renewal of registration, make an application of DPCC, in Form I.
• Every person recycling or processing waste or proposing to recycle or process plastic waste shall make an /
application to the DPCC, for grant of registration or renewal of registration for the recycling unit, in
Form II.
• Every manufacturer engaged in manufacturer of plastic to be used as raw material by the producer shall
make an application to the DPCC, for grant of registration or for the renewal of registration, in Form m.
And whereas, you Mis (as per list of 1278 units enclosed) (herein after referred as the addressee) is engaged in the
activity of (as per list enclosed) operating your unit at the said address without having valid Registration under
Plastic Waste Management Rules.
Now therefore, the Competent Authority in Delhi Pollution Control Committee, in exercise of powers conferred
upon it, u/s 5 of Environment Protection Act, 1986 read along with Plastic Rules, 2016 as amended to date, directed
all the Recyclers/ Manufacturers (Plastic to be used as raw material by the producer) in NCT of Delhi to apply
online at the website ofDPCC at :http://dpcc.delhigovt.nic.in for Registration/ Renewal under the Plastic Waste
Management (Amendment) Rules, 2018 along with copy of Consent obtained/ applied, MSME certificate and
related documents immediately, failing which, action shall be taken against the defaulter units including closure of
the unit, disconnection of electricity / water supply and levying of Environmental Compensation as per provisions
of the said Rules.
